These terms

These terms apply to photography and film work carried out by AXIS IMAGING LTD, registered in England and Wales under company number 13983978. They apply alongside the quotation we send you. Where a written quotation or a client contract says something different, that document wins.

Quotes and booking

Quotations are valid for 30 days. A booking is confirmed when you accept a quotation in writing and we hold the date in the diary. Site visits start from £350 plus VAT, and the final figure depends on the scope agreed in your quotation.

Payment

Invoices are payable within 30 days of the invoice date unless we have agreed otherwise in writing. We may charge statutory interest on late payment under the Late Payment of Commercial Debts (Interest) Act 1998.

Cancellation and postponement

Weather, site access and programme changes are part of construction work and we will always try to move a date rather than charge for it. Where a confirmed booking is cancelled or postponed at less than 48 hours notice, and we cannot fill the day, we may charge up to half of the agreed fee for that visit. Costs already committed, such as travel or hired equipment, are charged in full.

Access, safety and delays

You are responsible for arranging site access, inductions and any permissions we need from the principal contractor or building owner. We hold the CAA permissions and insurance our work requires and we will send certificates before the visit. Where flying is not possible on the day for reasons of weather, airspace restriction or safety, we will reschedule the aerial element at no additional fee.

Delivery

A first cut usually reaches you within 24 hours of the shoot, and final delivery dates are agreed at the brief. Your quotation states how many rounds of amends are included. Further changes are charged at our standard rate.

Copyright and how you can use the work

Copyright in all photographs and films remains with AXIS IMAGING LTD. On payment of the invoice in full, we grant you a permanent, worldwide, non exclusive licence to use the finished work for your own marketing, including your website, social channels, bids, tenders, press, printed material and site hoardings. You may not resell the work, license it to a third party, or pass it to another supplier as their own.

We keep the right to show the work in our own portfolio, on our website and on our social channels. If a project is confidential, tell us at the brief and we will agree that in writing.

People in the work

Where a film features named individuals, you confirm that you have their agreement to appear. We will remove an individual from unpublished material on reasonable request.

Liability

We carry public liability insurance of £5m and aviation insurance meeting Regulation EC785/2004 for drone operations. Our total liability in connection with any commission is limited to the fees paid for that commission. We are not liable for indirect or consequential loss, including loss of profit or loss of opportunity. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
